New Pieces of Subordinate Legislation (Ministerial Regulations) under the new Customs Act, B.E. 2560 (2017)
The new customs law, the Customs Act, B.E. 2560 (2018) (the “Act”) was published in the Royal Gazette in May 2017. An enactment of this new Act necessitates the Minister of Finance to issue several Ministerial Regulations by virtue of this Act. In November 2017, the Minister of Finance issues 13 Ministerial Regulations by virtue of this Act. Among those Ministerial Regulations, the crucial Ministerial Regulations are:
1. The Ministerial Regulation Re Stipulating and Use of a Customs Price B.E. 2560 (2017), which elaborate on how a customs price of an imported good is computed by several methods;
2. The Ministerial Regulation Re Stipulating Criteria for Reduction in Surcharge, B.E. 2560 (2017);
3. The Ministerial Regulation Re Permission for Establishment and Cancellation of Operation of a Bonded Warehouse, a Depot, a Place of Security and a Licensed Port, B.E. 2560 (2017);
4. The Ministerial Regulation Re Establishment and Cancellation of Operation of a Duty Free Zone, B.E. 2560 (2017); and
5. The Ministerial Regulation Re Permission for Business Operation in a Duty Free Zone, B.E. 2560 (2017).
